Terms of service

1 Conditions:

It is expected that you read these Terms of Service in full and you will be asked to say you have read and agreed to this document when you apply for any service provided by MB-Group.net (or related companies) or its staff.

2 Server Abuse:

Any attempt to undermine or cause harm to a server, or customer, of MB-Group.net (or related companies) or its affiliates is strictly prohibited. Unauthorized use of other people's accounts or computers MB-Group.net (or related companies) will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc. Any unauthorized use of accounts or computers by a MB-Group.net (or related companies) customer, whether or not the attacked account or computer belongs to MB-Group.net (or related companies), will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

3 MB-Group.net (or related companies) reserves the right

to discontinue service, or deny access to anyone who violates our policies or the terms and conditions shown below without warning or prior notice, however we will attempt to contact you through every stage of problems. No refunds of fees paid will be made if account termination is due to violation of the terms outlined below. Customers may not run IRC, bots or clients. Unacceptable uses also include, but are NOT limited to: Bulk emailing, unsolicited mailings, newsgroup spamming, pornographic content, illegal content, copyright infringement, trademark infringement, wares, cracks, software serial numbers, and/or anything else determined by MB-Group.net (or related companies) to be unacceptable use of MB-Group.net (or related companies) services including abuse of server resources.

Accounts may be terminated that include the following content or which have links to the following content:

Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity Promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual Displaying material containing obscene nudity or pornographic material Displaying material that exploits children under 18 years of age, Acts of copyright infringement including offering pirated computer programs or links to such programs, information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities

4 Unsolicited Email (Spam)

Any unsolicited advertising through any means (email, or passing on members email addresses) is not allowed, and will most likely result in account suspension or termination. Also "Spamming" the MB-Group.net (or related companies) website, or anything relating to it, is not allowed anywhere. Advertise us by all means, but if we receive complaints of people spamming our good name accounts may be suspended or terminated.

E-mail bombing is frowned at, if you are found deliberately bombing, your account will be suspended without notice.

5 IRC

We currently do not allow IRC or IRC bots to be ran on our servers.

6 SHOUTcast Services

We currently do not allow SHOUTcast (or any related audio streaming software) to be installed on the server (excluding VPS and Dedicated solutions)

7 Payment Policies/Options

All accounts set up with MB-Group.net (or related companies) will be charged on a monthly basis. All usage will be reset at the start of each month and that amount will have to last till the end of the month. MB-Group.net (or related companies) reserves the right to change its plans at any time, but in the case of a price increase, customers will be notified by email address letting them know and asking if they would like to continue with their current hosting options. MB-Group.net (or related companies) does not provide any direct debit features. It is solely the clients’ responsibility to pay for MB-Group.net (or related companies)'s services, and failure to do so may result in a suspension of the account. MB-Group.net (or related companies) reserves the right to delete any accounts which have not been paid within a week, of email notice. If you would like your account to be cancelled you may lodge a request with one of our technical support staff, who will ask you for information that you provided during registration, if you don not answer this correctly your account will not be disabled. Any person/s who cannot pay with the accepted ways should contact the MB-Group.net (or related companies) Sales area and ask what other options are possible. MB-Group.net (or related companies) Strives to have 100% customer satisfaction and we will look into other avenues of payment if the customer is unable to pay by the accepted means.

8 Cancellation

MB-Group.net (or related companies) and all its departments reserve the right to cancel any service at any time. Any fees paid in advance will be returned to the customer. If any violation of these Terms Have been broken at a cost to MB-Group.net (or related companies) we reserve the right to deny refunds of fees paid in advance to cover costs. If the customer hasn’t paid in advance we reserve the right to invoice the customer the amount caused by the breach of contract. MB-Group.net (or related companies) Reserves the right to delete any and all files infringing on these terms, and also reserves the right to delete all files if an account is cancelled

9 Lawful Purpose:

MB-Group.net (or related companies) reserves the right to refuse service to anyone. Customers may only use MB-Group.net (or related companies) server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The designation of any materials as such described above is left entirely to the discretion of MB-Group.net (or related companies) management.

10 Disclaimer

Anyone who registers for any services provided by MrHost® is held personally responsible for anything that is held on that account. Anyone who is found to have breached these Terms of Service is liable and their account will be terminated and the registrant will be liable for any fees which this action might incur. Any violations of law or terms will be forwarded to the account holder, and if payment for damages is required MB-Group.net (or related companies) reserves the right to charge the customer for any fees and also any legal costs. MB-Group.net (or related companies) reserves the right to create copies of data used on website (mainly for backup purposes), or for revision of our own coding skills.

These terms and the policies herein are a legally binding contract, and by you agreeing to them, you also agree to pay for any legal charges incurred by MB-Group.net (or related companies) relating to you or your service. Also any fees for damages or wrongdoing will be passed onto the customer and the customer will have to correct the amount owed, or legal action may be taken.

11 Hacking, illegal files and scams

All websites and other services are scanned regularly to check for illegal files and downloads. If any are located on our server they will be removed. If they are continually found on our server your website may be terminated.

12 SHOUTcast Licencing

It is up to the client to pay various licences required to broadcast copyrighted audio on our servers. MB-Group.net (or related companies).com does not have licences to keep our costs low. Talk-shows or other broadcasts that are not copyrighted do not need to be licenced.

13 Abuse to staff

Any abuse to staff including but not limited to swearing, racism are strictly prohibited. This will result in either a warning, account suspension or account termination depending on the seriousness of the abuse.

14 Email and contact

To keep our records up to date, we occasionally email people with an update form to check information is correct. If this information is incorrect we may be unable to contact you about downtime and other serious matters.

15 Fair usage

Although our SHOUTCast plans are all unmetered, we prefer users not to use a high amount of bandwidth as it may affect our services for other clients.

16 Uptime

Although we try our hardest to maintain out uptime rating of 99%, downtime that is out of our control including but not limited to hardware replacements and network issues may occur and refunds will not be given.

17 Special Offers

MB-Group.net (or related companies).com reserves the right to cancel special offers before the end date if we feel it is required.

18 Refunds

Refunds may be given in extreme circumstances. Per GB of bandwidth used, a charge of £0.50 will be taken off the refund. If  you feel our service is not right we offer a 72 hour money back  guarantee, after that only extreme circumstances can grant a refund.  If you have made a cancellation request, and have forgotten to cancel your PayPal subscription and this has taken money out of your account, it is not refundable. We advise all customers using PayPal subscriptions to make sure this is cancelled before the next payment is made.

19 Content

MB-Group.net (or related companies).com has no control of what is uploaded to our clients web sites, or played on their SHOUTcast streams. It is the clients responsibility to make sure their web site/broadcast is free of copyrighted content. If copyrighted content is found, please report it to support@MB-Group.net (or related companies).com and we will take the action we feel is needed. This may result in termination, or even being reported to the correct authorities for your company.

20 Fraud/Client Information

It is against the law not to enter your correct name/address/telephone number when signing up to our client database. Please do not put fake information, this is classed as fraud. We may feel it is needed to report the client to the authorities, or suspend their account if fraudulent information is used. If you feel uncomfortable putting your real address/telephone number, simply put N/A (not applicable) in the text field. We require your full legal name and E-Mail address for contacting purposes.

21 Disk Allocations

All storage is listed in either MB, GB or TB. We count our gigabytes as 1000MB.

22 Account Backups

We regularly back up all clients services both on site and off site, but it is the clients duty to make their own backups. If a client would like their web site restoring, when it is NOT a fault of MB-Group.net (or related companies).com's, a charge of £10 will occur. 

23 Ordering a Product

By ordering a product at MB-Group.net (or related companies), you are accepting these terms of service.
